Terms of Service

Last updated: [Date you publish this]

These terms are an agreement between you and [Your full legal name], trading as Muselight ("Muselight", "we", "us"), a sole trader in the United Kingdom. They cover your use of the Muselight website, web app and Windows app (together, "the Service"). By creating an account or using the Service you agree to them. If you don't agree, please don't use the Service.

1. Who we are

Muselight is run by [Your full legal name]. You can contact us at [email protected] or by post at [Your business address].

2. Who can use Muselight

You must be at least 18 years old and able to enter into a binding contract. If you use the Service for a business, you confirm you have authority to accept these terms for it, and the business terms in section 12 apply.

3. Your account

  • Keep your sign-in details and any sign-in code private. You're responsible for activity on your account.
  • Tell us straight away at [email protected] if you think someone else has used your account.
  • Give us accurate information, and keep your email address up to date so we can reach you.

4. Muselight Credits

  • The Service runs on a prepaid balance ("Credits"), shown in US dollars. You top up in advance and each run is paid from your balance.
  • The price of each run is shown before it starts, and the amount shown is the amount taken. Prices vary by model and settings and may change over time, but a price change never affects a run you've already started.
  • If a run fails or is cancelled before it starts, its price is returned to your balance automatically.
  • Credits can only be used on Muselight. They have no cash value, can't be transferred to another account, and don't earn interest.
  • Your Credits don't expire while your account is open. If we ever close the Service, we'll refund any balance you have left.
  • Refunds of unused Credits are covered by our Refund Policy.

5. Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's buyer terms apply to your purchase, and Paddle charges any sales tax or VAT due. We never see or store your full card details.

6. AI models from other companies

Muselight gives you access to AI models made and run by other companies (for example fal, Kling, Google, ByteDance and Black Forest Labs). To run a model, your prompt, settings and any files you upload are sent to the company that runs it. Some models have their own usage terms, for example on commercial use, which we link to in the app where they apply. Models can change, be updated or be withdrawn by the companies that provide them, and we can't guarantee any particular model stays available.

Who runs each model. Many models are available from more than one supplier (for example fal, Atlas Cloud, WaveSpeed, Runware or the model's own maker). Unless you choose one, we pick the supplier for each run, usually the cheapest that supports your settings, and the price shown before you run is the price you pay. Closed models are run only by the company that made them, so they are the same whichever supplier we use. Open models (whose weights are public) are run by each supplier on its own hardware, and the version, precision and supported settings can differ, so results, quality and speed may vary slightly between suppliers. For these models you can choose a supplier in the app; if you do, we only use that supplier. If a supplier fails during a run, we may complete it with another supplier at no extra cost, or refund it.

7. Your content

  • What you put in: you keep all rights in your prompts and uploads ("Inputs"). You give us a limited licence to store, process and send them to model providers, only as needed to run the Service for you.
  • What comes out: as between you and us, you own what you create ("Outputs"), as far as the law and the model's terms allow. We don't claim ownership of your Outputs. AI can produce similar results for different people, so Outputs may not be unique, and in some countries AI-generated works may have limited copyright protection.
  • Your responsibility: you're responsible for your Inputs and for how you use your Outputs. You must have the rights you need in anything you upload, including permission from any real person shown in it.
  • No training: we don't use your Inputs or Outputs to train AI models.

8. What you can't do

You must follow our Acceptable Use Policy, which is part of these terms. We may refuse, block or remove any request or result that breaks it.

9. AI output and accuracy

AI models can produce results that are inaccurate, unexpected or offensive, and results vary between runs. Check Outputs before you rely on or publish them. The Service is provided to help you create; it isn't professional advice of any kind.

10. Changes and availability

We work hard to keep Muselight running smoothly, but we can't promise it will always be available or free of errors. We may change, add or remove features. If we make a change that materially affects you, we'll tell you in advance where we reasonably can. We may update these terms; if a change is significant, we'll let you know by email or in the app before it takes effect, and you can close your account if you don't agree.

11. Suspending or closing accounts

You can close your account at any time by contacting [email protected]. We may suspend or close your account if you seriously or repeatedly break these terms, if we must do so by law, or to protect other users or the Service. If we close your account without fault on your part, we'll refund your remaining balance. If we close it because you broke the Acceptable Use Policy or committed fraud, we may keep any Credits involved, as far as the law allows.

12. Our responsibility to you

If you're a consumer: we're responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We're not responsible for loss that wasn't foreseeable, for loss caused by events outside our reasonable control, or for business losses. Nothing in these terms affects your legal rights under the Consumer Rights Act 2015 or other consumer law.

If you're using Muselight for a business: to the extent the law allows, our total liability to you under or in connection with these terms is limited to the amount you paid us in the 12 months before the claim, and we're not liable for loss of profits, revenue, business, data or goodwill.

For everyone: nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited or excluded by law.

13. Disputes and law

If you have a problem, please contact us at [email protected] first: we'll try to sort it out quickly. These terms are governed by the law of England and Wales. You can bring claims in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring claims in your local courts.
